We discuss how the law and scholars have approached three questions. First, what acts count as acts of entrapment? Secondly, is entrapment a permissible method of law-enforcement and, if so, in what circumstances? Thirdly, what must criminal courts do, in response to the finding that an offence was brought about by an act of entrapment, in order to deliver justice? While noting the contrary tendency, we suggest that the first question should be addressed in a manner that is neutral about (...) the answers to the other two. On the second question, we summarize various arguments about the permissibility of entrapment, while remaining largely neutral about their merits. With regard to the third question, we summarize the approaches to entrapment in various jurisdictions, and we note some patterns, across the jurisdictions here surveyed, concerning shifts from one sort of entrapment remedy to another. Fleming, Daniel J; Ryan, Thomas Three recent phrases of Pope Francis warrant attention and guide this article. First, there is his call for 'witnesses of God's love' in his tribute to modern martyrs. The second is 'the pedagogy of grace' and the work of the Spirit explained in 'Amoris Laetitia'. Third, from the same document, we find his discussion of accompaniment in the process of moral discernment within the church. With these as guideposts and drawing on recent studies in (...) moral philosophy and psychology, this article unfolds in five steps: setting the scene; witness in relation to moral understanding and intersubjectivity; intersubjectivity and conscience; a pedagogy of grace: Holy Spirit and nonbelievers; and a pedagogy of grace in relation to moral development. Since the 1970s, a sea change has marked the politics of science in the United States. In the quarter century after World War II, a broad, bipartisan consensus prevailed on the promotion and uses of science in American society: first, that the federal government should support research and training in technically meritorious fields of likely long-term benefit to national defense, the economy, and health; second, that the benefits of this investment should be developed into useful products by the private sector; (...) and that public policy in technically related areas should be shaped by drawing on highly qualified, non-partisan expertise. Since the 1970s, that bipartisan consensus has corroded, ushering in a New Politics of Science in the U.S. Ideological restrictions, largely from the political right, have prohibited or severely constricted federal support of research in areas such as human therapeutic cloning, human stem cells, in vitro fertilization, and human embryo research. The devotion to privatization and entrepreneurship in the name of high technology competitiveness has, in areas such as biotechnology, blurred the lines both intellectually and institutionally between academia and industry, with questionable consequences for the public interest. And nonpartisanship in the scientific advisory system has been succeeded by unashamed partisanship, fueled by the mobilization of expertise on the right in issues ranging from the teaching of evolution in the schools to global warming. The reasons for this sea change can be found in the larger rightward shift over the period on both the foreign and domestic fronts. (shrink)

There is a global consensus of ethicists, politicians, physicians, and international documents that reject any sort of market in human organs. Indeed, this issue has received much attention in the literature in the past few decades, with the majority of commentators placing a high correlation between the sale of organs and financial exploitation. While this argument may be tenable, this analysis seeks to draw out further implications of organ sale, including the idea of moralistic exploitation and the concept that providing (...) a market in a nonmarket good may crowd out certain morals that we should care about. This article will initially discuss the issue of moralistic exploitation, drawing implications from the 2005 UNESCO Declaration on Bioethics and Human Rights and will conclude with applying Michael Sandel’s concept that markets crowd out morals to the issue of organ markets. There was a time when Greco-Roman culture recognized faith as an indispensable social good. More recently, however, the value of faith has been called into question, particularly in connection with religious commitment. What, if anything, is valuable about faith—in the context of ordinary human relations or as a distinctive stance people might take in relation to God? I approach this question by examining the role that faith talk played both in ancient Jewish and Christian communities and in the larger Greco-Roman (...) culture in which Christian faith talk evolved. I locate the value of faith and faithfulness in the context of relationships involving trust and loyalty and argue that what is most distinctively valuable about faith is the function it plays in sustaining relationships through various kinds of challenges, including through evidentially unfavorable circumstances and significant periods of doubt. In light of this discussion, I set out a view of relational faith and, taking Mother Teresa as an exemplar, argue for two further conclusions. First, faith can play the valuable role that it plays in sustaining relationships even without belief of the salient propositions. Second, in at least some circumstances, in order for faith to play this valuable role in a way that does not require epistemic opinions that fail to fit one’s evidence, it is important that faith does not require such belief. In Aleksandr Solzhenitsyn, Daniel Mahoney presents a philosophical perspective on the political condition of modern man through an exegesis and analysis of Solzhenitsyn's work. Mahoney demonstrates the tremendous, yet often unappreciated, impact of Sozhenitsyn's writing on twentieth century thinking through an examination of the writer's profoundly important critique of communist totalitarianism in a judicious and original mix of western and Russian, Christian and classical wisdom.

The dissertation sketches a solution to the problem of pictorial representation. By appealing to the visual system as an information processing system, we understand how it is that certain sorts of pictures are seen as representing their subjects. ;The first chapter introduces the problem and discusses existing philosophical treatment of pictorial representation. Conventionalist arguments against the possibility of a naturalist account are refuted, thus clearing the way for a naturalist, realist, "resemblance" view of pictorial representation. ;The second chapter discusses the (...) notion of the modularity of mind. Aspects of perceptual holism are criticized. I support the modularist claim that one can make a useful distinction between observation and inference without suffering familiar positivist problems. I suggest that much of vision can fruitfully be studied in isolation from other mental processes. ;The third and fourth chapters provide a contemporary account of human vision. A model of the neural circuitry of vision is provided. Similar treatment is given to mathematical modeling of spatial vision . Also, some attention is paid to lower level biological details and to higher level functional attributes of the system. Research methodologies are discussed, as are the connections between the various levels of investigation. ;The concluding chapter begins with a theoretical and methodological comparison of experimental work cited as empirical foundation for various forms of conventionalism with that supporting modularity . The questions of Chapter I are then reconsidered in light of the vision science of Chapters III and IV. It is shown that current understanding of vision elucidates many of the problems of pictorial representation. Especially relevant is the observation that human spatial vision functions by abstracting certain features from the environment, features that are preserved in certain sorts of pictures. It turns out that many of the conventionalist claims about mind, vision and pictorial representation are unsupportable, given current understanding of mind and vision. (shrink)

Bertrand Russell says of Leibniz that "the best parts of his philosophy are the most abstract and the worst those which most nearly concern human life". Many have agreed with Russell's comments and the treatment of Leibniz by most Anglo-American philosophers in particular during this century is a testimony to his sentiments. Even sympathetic commentators have been dismissive or apologetic of those aspects of Leibniz's thought that "concern human life". My purpose here is not to dear Leibniz of any and (...) all animadversions - personal or philosophical - but to attempt to understand the dissimulation and equivocality that even his admirers ascribe to his non-logical writings. It is my position that such qualities were intrinsic to his thought, and not simply personal quirks or flaws that have to be tolerated or dismissed in any sustained examination of his philosophy.
